1. Przedmiotem zamówienia jest realizacja usługi ubezpieczenia grupowego na życie pracowników, współmałżonków oraz pełnoletnich dzieci pracowników Urzędu Miasta Kalisza przy szacunkowej liczbie ubezpieczonych 592 osoby.

2. Postępowanie, którego dotyczy niniejsze ogłoszenie prowadzone jest w trybie przetargu nieograniczonego zgodnie z art. 39 ustawy z dnia 29.1.2004 r. Prawo zamówień publicznych (Dz.U. z 2018 r. poz. 1986 z późn. zm., zwaną w niniejszym ogłoszeniu „ustawą” lub „ustawą Pzp”).

3. Postępowanie, którego dotyczy niniejsze ogłoszenie prowadzone jest wyłącznie w formie elektronicznej przy użyciu środków komunikacji elektronicznej za pośrednictwem Platformy zakupowej dostępnej pod adresem https://miastokalisz.ezamawiajacy.pl, zwanej w niniejszym ogłoszeniu „Platformą”.

Miasto Kalisz, POLSKA.

1. Przedmiotem zamówienia jest realizacja usługi ubezpieczenia grupowego na życie pracowników, współmałżonków oraz pełnoletnich dzieci pracowników Urzędu Miasta Kalisza przy szacunkowej liczbie ubezpieczonych 592 osoby.

2. Szczegółowy opis przedmiotu zamówienia zawiera załącznik do SIWZ pn. „Szczegółowy opis przedmiotu zamówienia”, zawierający zakres ochrony, w tym warunki obligatoryjne, inne postanowienia dodatkowe oraz klauzule fakultatywne grupowe ubezpieczenia na życie pracowników, współmałżonków oraz pełnoletnich dzieci pracowników Urzędu Miasta Kalisza.

3. Postępowanie prowadzone jest przy udziale brokera ubezpieczeniowego Nord Partner Sp. z o.o. z siedzibą w Toruniu, który jako pośrednik ubezpieczeniowy działa na rzecz i w imieniu Zamawiającego. Broker ubezpieczeniowy będzie pośredniczył przy zawarciu umowy zawartej w wyniku rozstrzygnięcia niniejszego postępowania o udzielenie zamówienia, a następnie będzie nadzorował ich realizację przez Wykonawcę.

4. Szacunkowa liczba ubezpieczonych podana w pkt 1 lub SIWZ i załącznikach do SIWZ nie jest zobowiązaniem Zamawiającego do przystąpienia tej liczby osób do ubezpieczenia. Szacunkowa liczba ubezpieczonych ustalona została na potrzeby ustalenia wartości szacunkowej zamówienia oraz zapewnienia porównywalności ofert. Wykonawca nie może mieć roszczeń z tytułu nie przystąpienia wskazanej liczby osób do ubezpieczenia grupowego na życie.

5. Pozostałe warunki realizacji zamówienia znajdują się w projekcie umowy stanowiącym załącznik do SIWZ.

1. Wykonawca zobowiązany jest do wniesienia przed upływem terminu składania ofert wadium w wysokości 5 000,00 PLN.

2. Dowód wniesienia wadium należy dołączyć do oferty stosownie do zapisów SIWZ w tym zakresie.

3. Okres związania ofertą, o którym mowa w IV.2.6) niniejszego ogłoszenia wynosi 60 dni. Bieg terminu związania ofertą rozpoczyna się wraz z upływem terminu składania ofert.

A. O udzielenie zamówienia mogą ubiegać się Wykonawcy, którzy:

1. nie podlegają wykluczeniu z postępowania na podstawie art. 24 ust. 1 pkt 12-23 oraz art. 24 ust. 5 pkt 1, 8 ustawy Pzp;

2. spełniają warunek udziału w postępowaniu dotyczący kompetencji lub uprawnień do prowadzenia określonej działalności zawodowej tj. posiadają uprawnienia do prowadzenia działalność ubezpieczeniowej zgodnie z ustawą z dnia 11.9.2015 r. o działalności ubezpieczeniowej i reasekuracyjnej – obejmujące ubezpieczenie grupowe na życie.

B. W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, żaden z nich nie może podlegać wykluczeniu z postępowania z powodów, o których mowa w art. 24 ust. 1 pkt 12-23 oraz art. 24 ust. 5 pkt 1, 8 ustawy.

C. Każdy z Wykonawców ubiegający się wspólnie o udzielenie zamówienia (składający ofertę wspólnie w tym: członkowie konsorcjum, wspólnicy spółki cywilnej) musi samodzielnie spełnić warunek o którym mowa w pkt III.1) niniejszego ogłoszenia.

D. Wykonawca zobowiązany jest złożyć wraz z ofertą aktualne na dzień składania ofert, oświadczenie stanowiące wstępne potwierdzenie, że Wykonawca nie podlega wykluczeniu i spełnia warunki udziału w postępowaniu w formie jednolitego europejskiego dokumentu zamówienia (JEDZ), sporządzonego zgodnie z wzorem standardowego formularza określonego w rozporządzeniu wykonawczym Komisji Europejskiej wydanym na podstawie art. 59 ust. 2 dyrektywy 2014/24/UE. Wykonawca zobowiązany jest do wypełnienia JEDZ w takim zakresie, aby Zamawiający był w stanie zweryfikować czy Wykonawca nie podlega wykluczeniu i spełnia warunki udziału w postępowaniu określone w SIWZ. Ponadto w przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia formularz JEDZ składa każdy z tych Wykonawców.

E. W celu potwierdzenia spełnienia warunku udziału w postępowaniu wyłącznie na wezwanie Zamawiającego Wykonawca zobowiązany jest złożyć:

1) aktualne zezwolenie na prowadzenie działalności ubezpieczeniowej wydane zgodnie z przepisami ustawy z dnia 11.9.2015 r. o działalności ubezpieczeniowej i reasekuracyjnej (t.j. Dz.U. z 2019 r., poz. 381 z późn. zm.) – art. 162 ust. 1 ww. ustawy lub inne odpowiadające mu zezwolenie, które zostało wydane na podstawie wcześniej obowiązujących przepisów prawa, bądź – w przypadku rozpoczęcia działalności przed 28.8.1990 r. – zaświadczenia, wydanego przez Komisję Nadzoru Finansowego o posiadaniu uprawnień do prowadzenia działalności ubezpieczeniowej, bądź innego dokumentu właściwego organu na wykonywanie działalności ubezpieczeniowej w państwie członkowskim UE, w którym zakład ten ma siedzibę, potwierdzające posiadanie uprawnień do prowadzenia działalności ubezpieczeniowej w zakresie wszystkich grup ryzyk objętych przedmiotem zamówienia.

Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej, zamiast wyżej wymienionych dokumentów składa dokument lub dokumenty wystawione w kraju, w którym ma miejsce zamieszkania lub siedzibę, potwierdzające odpowiednio, że posiada uprawnienia do wykonywania działalności związanej z przedmiotem zamówienia.

A. W celu potwierdzenia braku podstaw wykluczenia Wykonawcy z udziału w postępowaniu wyłącznie na wezwanie Zamawiającego Wykonawca zobowiązany jest złożyć następujące oświadczenia i dokumenty:

1) informację z Krajowego Rejestru Karnego w zakresie określonym w art. 24 ust. 1 pkt 13, 14 i 21 ustawy wystawioną nie wcześniej niż 6 m-cy przed upływem terminu składania ofert;

2) zaświadczenie właściwego naczelnika urzędu skarbowego potwierdzające, że Wykonawca nie zalega z opłacaniem podatków, wystawione nie wcześniej niż 3 m-ce przed upływem terminu składania ofert, lub inny dokument potwierdzający, że Wykonawca zawarł porozumienie z właściwym organem podatkowym w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu;

3) zaświadczenie właściwej terenowej jednostki organizacyjnej Zakładu Ubezpieczeń Społecznych lub Kasy Rolniczego Ubezpieczenia Społecznego albo inny dokument potwierdzający, że Wykonawca nie zalega z opłacaniem składek na ubezpieczenia społeczne lub zdrowotne, wystawiony nie wcześniej niż 3 m-ce przed upływem terminu składania ofert, lub inny dokument potwierdzający, że Wykonawca zawarł porozumienie z właściwym organem w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu;

4) odpis z właściwego rejestru lub z Centralnej Ewidencji i Informacji o Działalności Gospodarczej, jeżeli odrębne przepisy wymagają wpisu do rejestru lub ewidencji, w celu potwierdzenia braku podstaw wykluczenia na podstawie art. 24 ust. 5 pkt 1 ustawy;

5) oświadczenie Wykonawcy o braku wydania wobec niego prawomocnego wyroku sądu lub ostatecznej decyzji administracyjnej o zaleganiu z uiszczaniem podatków, opłat lub składek na ubezpieczenia społeczne lub zdrowotne albo – w przypadku wydania takiego wyroku lub decyzji – dokumenty potwierdzające dokonanie płatności tych należności wraz z ewentualnymi odsetkami lub grzywnami lub zawarcie wiążącego porozumienia w sprawie spłat tych należności;

6) oświadczenie Wykonawcy o braku orzeczenia wobec niego tytułem środka zapobiegawczego zakazu ubiegania się o zamówienia publiczne;

7) oświadczenie Wykonawcy o niezaleganiu z opłacaniem podatków i opłat lokalnych, o których mowa w ustawie z dnia 12.1.1991 r. o podatkach i opłatach lokalnych (Dz.U. z 2019 r. poz. 1170).

B. W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia każdy z Wykonawców zobowiązany jest do złożenia na wezwanie Zamawiającego dokumentów wymienionych wyżej w pkt III.1.2)A.1)-7) niniejszego ogłoszenia dotyczących każdego z nich.

C. W przypadku Wykonawców prowadzących działalność w formie spółki cywilnej zaświadczenia, o których mowa wyżej w pkt III.1.2)A.2)-3) niniejszego ogłoszenia należy przedstawić w odniesieniu do wszystkich wspólników z osobna, jak i samej spółki.

D. Wykonawca, w terminie 3 dni od zamieszczenia na stronie internetowej Zamawiającego informacji, o której mowa w art. 86 ust. 5 ustawy, przekazuje Zamawiającemu oświadczenie o przynależności lub braku przynależności do tej samej grupy kapitałowej z Wykonawcami, którzy złożyli odrębne oferty w postępowaniu. W przypadku wspólnego ubiegania się o zamówienie przez Wykonawców oświadczenie, o którym mowa wyżej składa każdy z Wykonawców wspólnie ubiegających się o udzielenie zamówienia.

Zamawiający nie określa warunków udziału w postępowaniu dotyczących sytuacji ekonomicznej i finansowej.

Poniżej ciąg dalszy treści z pkt III.1.2) niniejszego ogłoszenia.

A. Wykonawca mający siedzibę na terytorium Rzeczypospolitej Polskiej, w odniesieniu do osoby mającej miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej, której dotyczy dokument wskazany w pkt III.1.2)A.1) niniejszego ogłoszenia, składa informację z odpowiedniego rejestru albo, w przypadku braku takiego rejestru, inny równoważny dokument wydany przez właściwy organ sądowy lub administracyjny kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania lub miejsce zamieszkania ma osoba, której dotyczy informacja albo dokument, w zakresie określonym w art. 24 ust. 1 pkt 14 i 21 ustawy – wystawione nie wcześniej niż 6 m-cy przed upływem terminu składania ofert. Jeżeli w kraju, w którym miejsce zamieszkania ma osoba, której dokument miał dotyczyć, nie wydaje się takich dokumentów, zastępuje się go dokumentem (wystawionym nie wcześniej niż 6 m-cy przed upływem terminu składania ofert) zawierającym oświadczenie tej osoby złożonym przed notariuszem lub przed organem sądowym, administracyjnym albo organem samorządu zawodowego lub gospodarczego właściwym ze względu na miejsce zamieszkania tej osoby.

B. Dokumenty podmiotów zagranicznych

Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej – zamiast dokumentów, o których mowa w pkt w pkt III.1.2)A.2)-4) niniejszego ogłoszenia – składa dokument lub dokumenty wystawione w kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania potwierdzające odpowiednio, że:

a) nie zalega z opłacaniem podatków, opłat, składek na ubezpieczenie społeczne lub zdrowotne albo że zawarł porozumienie z właściwym organem w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu – wystawione nie wcześniej niż 3 m-cy przed upływem terminu składania ofert,

b) nie otwarto jego likwidacji ani nie ogłoszono upadłości – wystawione nie wcześniej niż 6 m-cy przed upływem terminu składania ofert.

C. Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej – zamiast dokumentów, o których mowa w pkt III.1.2)A.1) niniejszego ogłoszenia – składa informację z odpowiedniego rejestru albo, w przypadku braku takiego rejestru, inny równoważny dokument wydany przez właściwy organ sądowy lub administracyjny kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania lub miejsce zamieszkania ma osoba, której dotyczy informacja albo dokument, w zakresie określonym w art. 24 ust. 1 pkt 13, 14 i 21 ustawy – wystawione nie wcześniej niż 6 m-cy przed upływem terminu składania ofert.

D. Jeżeli w kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania lub miejsce zamieszkania ma osoba, której dokument dotyczy, nie wydaje się dokumentów, o których mowa w pkt III.1.3)B.-C. niniejszego ogłoszenia, zastępuje się je dokumentem (wystawionym odpowiednio nie wcześniej niż 3 lub 6 miesięcy przed upływem terminu składania ofert – patrz wyżej) zawierającym odpowiednio oświadczenie Wykonawcy, ze wskazaniem osoby albo osób uprawnionych do jego reprezentacji, lub oświadczenie osoby, której dokument miał dotyczyć, złożone przed notariuszem lub przed organem sądowym, administracyjnym albo organem samorządu zawodowego lub gospodarczego właściwym ze względu na siedzibę lub miejsce zamieszkania Wykonawcy lub miejsce zamieszkania tej osoby.

Zamawiający nie określa warunków udziału w postępowaniu dotyczących zdolności technicznej i kwalifikacji zawodowych.

1. Szczegółowe warunki realizacji zamówienia znajdują się w SIWZ i załącznikach do niej.

2. Zakres, charakter zmian oraz warunki wprowadzenia zmian zawarte zostały w projekcie umowy stanowiącym załącznik do SIWZ.

1. Otwarcie ofert nastąpi poprzez upublicznienie wczytanych na Platformie ofert w terminie wskazanym w pkt IV.2.7) niniejszego ogłoszenia.

2. Zamawiający rozpocznie sesję otwierania złożonych ofert w terminie wskazanym w pkt IV.2.7) niniejszego ogłoszenia w pokoju nr 36 mieszczącym się na I piętrze budynku Urzędu Miasta Kalisza przy Głównym Rynku 20 w Kaliszu (Sala Narad).

Otwarcie ofert jest jawne i dostępne dla wszystkich.

I kwartał 2022 r.

1. Ofertę sporządza się pod rygorem nieważności w postaci elektronicznej i opatruje kwalifikowanym podpisem elektronicznym osoby / osób uprawnionej/ych do składania oświadczeń woli w imieniu Wykonawcy.

3. Złożenie oferty w przedmiotowym postępowaniu wiąże się z koniecznością posiadania bezpłatnego aktywnego konta Wykonawca na portalu OnePlace, dostępnego pod adresem: https://oneplace.marketplanet.pl

4. Komunikacja między Zamawiającym a Wykonawcami, w tym wszelkie oświadczenia, wnioski, zawiadomienia oraz informacje, przekazywane są w formie elektronicznej wyłącznie przy użyciu środków komunikacji elektronicznej za pośrednictwem Platformy. Szczegółowe informacje odnośnie formy przekazywanych oświadczeń lub dokumentów, pełnomocnictw oraz zasad ich przekazywania zawiera SIWZ.

5. Adres poczty elektronicznej podany w pkt I.1) niniejszego ogłoszenia nie służy do porozumiewania się Zamawiającego z Wykonawcami w postępowaniu, którego dotyczy niniejsze ogłoszenie.

6. Wszelkie informacje związane z przedmiotowym postępowaniem zamieszczane są na stronie internetowej Platformy, tj. pod adresem https://miastokalisz.ezamawiajacy.pl

7. W postępowaniu, którego dotyczy niniejsze ogłoszenie będzie miała zastosowanie procedura, o której mowa w art. 24aa ustawy.

1. Odwołanie przysługuje wyłącznie od niezgodnej z przepisami ustawy czynności Zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania czynności, do której Zamawiający jest zobowiązany na podstawie ustawy.

2. Odwołanie powinno wskazywać czynność lub zaniechanie czynności Zamawiającego, której zarzuca się niezgodność z przepisami ustawy, zawierać zwięzłe przedstawienie zarzutów, określać żądanie oraz wskazywać okoliczności faktyczne i prawne uzasadniające wniesienie odwołania.

3. Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w formie pisemnej w postaci papierowej albo w postaci elektronicznej, opatrzone odpowiednio własnoręcznym podpisem albo kwalifikowanym podpisem elektronicznym.

5. Zgodnie z art. 182 ustawy Prawo zamówień publicznych:

1) Odwołanie wnosi się w terminie 10 dni od dnia przesłania informacji o czynności Zamawiającego stanowiącej podstawę jego wniesienia – jeżeli zostały przesłane w sposób określony w art. 180 ust. 5 zdanie drugie ustawy Prawo zamówień publicznych albo w terminie 15 dni – jeżeli zostały przesłane w inny sposób.

2) Odwołanie wobec treści ogłoszenia o zamówieniu, a także wobec postanowień Specyfikacji Istotnych Warunków Zamówienia, wnosi się w terminie 10 dni od dnia publikacji ogłoszenia w Dzienniku Urzędowym Unii Europejskiej lub zamieszczenia Specyfikacji Istotnych Warunków Zamówienia na stronie internetowej.

3) Odwołanie wobec czynności innych niż określone w pkt 1) i 2) wnosi się w terminie 10 dni od dnia, w którym powzięto lub przy zachowaniu należytej staranności można było powziąć wiadomość o okolicznościach stanowiących podstawę jego wniesienia.

2. spełniają warunek udziału w postępowaniu dotyczący kompetencji lub uprawnień do prowadzenia określonej działalności zawodowej tj. posiadają uprawnienia do prowadzenia działalność ubezpieczeniowej zgodnie z ustawą z dnia 11.9.2015 r. o działalności ubezpieczeniowej i reasekuracyjnej – obejmujące ubezpieczenie grupowe na życie.

B. W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia, żaden z nich nie może podlegać wykluczeniu z postępowania z powodów, o których mowa w art. 24 ust. 1 pkt 12-23 oraz art. 24 ust. 5 pkt 1, 8 ustawy.

C. Każdy z Wykonawców ubiegający się wspólnie o udzielenie zamówienia (składający ofertę wspólnie w tym: członkowie konsorcjum, wspólnicy spółki cywilnej) musi samodzielnie spełnić warunek o którym mowa w pkt III.1) niniejszego ogłoszenia.

D. Wykonawca zobowiązany jest złożyć wraz z ofertą aktualne na dzień składania ofert, oświadczenie stanowiące wstępne potwierdzenie, że Wykonawca nie podlega wykluczeniu i spełnia warunki udziału w postępowaniu w formie jednolitego europejskiego dokumentu zamówienia (JEDZ), sporządzonego zgodnie z wzorem standardowego formularza określonego w rozporządzeniu wykonawczym Komisji Europejskiej wydanym na podstawie art. 59 ust. 2 dyrektywy 2014/24/UE. Wykonawca zobowiązany jest do wypełnienia JEDZ w takim zakresie, aby Zamawiający był w stanie zweryfikować czy Wykonawca nie podlega wykluczeniu i spełnia warunki udziału w postępowaniu określone w SIWZ. Ponadto w przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia formularz JEDZ składa każdy z tych Wykonawców.

E. W celu potwierdzenia spełnienia warunku udziału w postępowaniu wyłącznie na wezwanie Zamawiającego Wykonawca zobowiązany jest złożyć:

1) aktualne zezwolenie na prowadzenie działalności ubezpieczeniowej wydane zgodnie z przepisami ustawy z dnia 11.9.2015 r. o działalności ubezpieczeniowej i reasekuracyjnej (t.j. Dz.U. z 2019 r., poz. 381 z późn. zm.) – art. 162 ust. 1 ww. ustawy lub inne odpowiadające mu zezwolenie, które zostało wydane na podstawie wcześniej obowiązujących przepisów prawa, bądź – w przypadku rozpoczęcia działalności przed 28.8.1990 r. – zaświadczenia, wydanego przez Komisję Nadzoru Finansowego o posiadaniu uprawnień do prowadzenia działalności ubezpieczeniowej, bądź innego dokumentu właściwego organu na wykonywanie działalności ubezpieczeniowej w państwie członkowskim UE, w którym zakład ten ma siedzibę, potwierdzające posiadanie uprawnień do prowadzenia działalności ubezpieczeniowej w zakresie wszystkich grup ryzyk objętych przedmiotem zamówienia.

Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej, zamiast wyżej wymienionych dokumentów składa dokument lub dokumenty wystawione w kraju, w którym ma miejsce zamieszkania lub siedzibę, potwierdzające odpowiednio, że posiada uprawnienia do wykonywania działalności związanej z przedmiotem zamówienia.

A. W celu potwierdzenia braku podstaw wykluczenia Wykonawcy z udziału w postępowaniu wyłącznie na wezwanie Zamawiającego Wykonawca zobowiązany jest złożyć następujące oświadczenia i dokumenty:

1) informację z Krajowego Rejestru Karnego w zakresie określonym w art. 24 ust. 1 pkt 13, 14 i 21 ustawy wystawioną nie wcześniej niż 6 m-cy przed upływem terminu składania ofert;

2) zaświadczenie właściwego naczelnika urzędu skarbowego potwierdzające, że Wykonawca nie zalega z opłacaniem podatków, wystawione nie wcześniej niż 3 m-ce przed upływem terminu składania ofert, lub inny dokument potwierdzający, że Wykonawca zawarł porozumienie z właściwym organem podatkowym w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu;

3) zaświadczenie właściwej terenowej jednostki organizacyjnej Zakładu Ubezpieczeń Społecznych lub Kasy Rolniczego Ubezpieczenia Społecznego albo inny dokument potwierdzający, że Wykonawca nie zalega z opłacaniem składek na ubezpieczenia społeczne lub zdrowotne, wystawiony nie wcześniej niż 3 m-ce przed upływem terminu składania ofert, lub inny dokument potwierdzający, że Wykonawca zawarł porozumienie z właściwym organem w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu;

4) odpis z właściwego rejestru lub z Centralnej Ewidencji i Informacji o Działalności Gospodarczej, jeżeli odrębne przepisy wymagają wpisu do rejestru lub ewidencji, w celu potwierdzenia braku podstaw wykluczenia na podstawie art. 24 ust. 5 pkt 1 ustawy;

5) oświadczenie Wykonawcy o braku wydania wobec niego prawomocnego wyroku sądu lub ostatecznej decyzji administracyjnej o zaleganiu z uiszczaniem podatków, opłat lub składek na ubezpieczenia społeczne lub zdrowotne albo – w przypadku wydania takiego wyroku lub decyzji – dokumenty potwierdzające dokonanie płatności tych należności wraz z ewentualnymi odsetkami lub grzywnami lub zawarcie wiążącego porozumienia w sprawie spłat tych należności;

6) oświadczenie Wykonawcy o braku orzeczenia wobec niego tytułem środka zapobiegawczego zakazu ubiegania się o zamówienia publiczne;

7) oświadczenie Wykonawcy o niezaleganiu z opłacaniem podatków i opłat lokalnych, o których mowa w ustawie z dnia 12.1.1991 r. o podatkach i opłatach lokalnych (Dz.U. z 2019 r. poz. 1170).

B. W przypadku Wykonawców wspólnie ubiegających się o udzielenie zamówienia każdy z Wykonawców zobowiązany jest do złożenia na wezwanie Zamawiającego dokumentów wymienionych wyżej w pkt III.1.2)A.1)-7) niniejszego ogłoszenia dotyczących każdego z nich.

C. W przypadku Wykonawców prowadzących działalność w formie spółki cywilnej zaświadczenia, o których mowa wyżej w pkt III.1.2)A.2)-3) niniejszego ogłoszenia należy przedstawić w odniesieniu do wszystkich wspólników z osobna, jak i samej spółki.

D. Wykonawca, w terminie 3 dni od zamieszczenia na stronie internetowej Zamawiającego informacji, o której mowa w art. 86 ust. 5 ustawy, przekazuje Zamawiającemu oświadczenie o przynależności lub braku przynależności do tej samej grupy kapitałowej z Wykonawcami, którzy złożyli odrębne oferty w postępowaniu. W przypadku wspólnego ubiegania się o zamówienie przez Wykonawców oświadczenie, o którym mowa wyżej składa każdy z Wykonawców wspólnie ubiegających się o udzielenie zamówienia.

Zamawiający nie określa warunków udziału w postępowaniu dotyczących sytuacji ekonomicznej i finansowej.

A. Wykonawca mający siedzibę na terytorium Rzeczypospolitej Polskiej, w odniesieniu do osoby mającej miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej, której dotyczy dokument wskazany w pkt III.1.2)A.1) niniejszego ogłoszenia, składa informację z odpowiedniego rejestru albo, w przypadku braku takiego rejestru, inny równoważny dokument wydany przez właściwy organ sądowy lub administracyjny kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania lub miejsce zamieszkania ma osoba, której dotyczy informacja albo dokument, w zakresie określonym w art. 24 ust. 1 pkt 14 i 21 ustawy – wystawione nie wcześniej niż 6 m-cy przed upływem terminu składania ofert. B. Dokumenty podmiotów zagranicznych

Jeżeli Wykonawca ma siedzibę lub miejsce zamieszkania poza terytorium Rzeczypospolitej Polskiej – zamiast dokumentów, o których mowa w pkt w pkt III.1.2)A.2)-4) niniejszego ogłoszenia – składa dokument lub dokumenty wystawione w kraju, w którym Wykonawca ma siedzibę lub miejsce zamieszkania potwierdzające odpowiednio, że:

a) nie zalega z opłacaniem podatków, opłat, składek na ubezpieczenie społeczne lub zdrowotne albo że zawarł porozumienie z właściwym organem w sprawie spłat tych należności wraz z ewentualnymi odsetkami lub grzywnami, w szczególności uzyskał przewidziane prawem zwolnienie, odroczenie lub rozłożenie na raty zaległych płatności lub wstrzymanie w całości wykonania decyzji właściwego organu – wystawione nie wcześniej niż 3 m-cy przed upływem terminu składania ofert,

C. Zamawiający nie określa warunków udziału w postępowaniu dotyczących zdolności technicznej i kwalifikacji zawodowych.

1. Szczegółowe warunki realizacji zamówienia znajdują się w SIWZ i załącznikach do niej.

2. Zakres, charakter zmian oraz warunki wprowadzenia zmian zawarte zostały w projekcie umowy stanowiącym załącznik do SIWZ.

1. Otwarcie ofert nastąpi poprzez upublicznienie wczytanych na Platformie ofert w terminie wskazanym w pkt IV.2.7) niniejszego ogłoszenia.

2. Zamawiający rozpocznie sesję otwierania złożonych ofert w terminie wskazanym w pkt IV.2.7) niniejszego ogłoszenia w pokoju nr 36 mieszczącym się na I piętrze budynku Urzędu Miasta Kalisza przy Głównym Rynku 20 w Kaliszu (Sala Narad).

Otwarcie ofert jest jawne i dostępne dla wszystkich.

4. Komunikacja między Zamawiającym a Wykonawcami, w tym wszelkie oświadczenia, wnioski, zawiadomienia oraz informacje, przekazywane są w formie elektronicznej wyłącznie przy użyciu środków komunikacji elektronicznej za pośrednictwem Platformy. Szczegółowe informacje odnośnie formy przekazywanych oświadczeń lub dokumentów, pełnomocnictw oraz zasad ich przekazywania zawiera SIWZ.

5. Adres poczty elektronicznej podany w pkt I.1) niniejszego ogłoszenia nie służy do porozumiewania się Zamawiającego z Wykonawcami w postępowaniu, którego dotyczy niniejsze ogłoszenie.

6. Wszelkie informacje związane z przedmiotowym postępowaniem zamieszczane są na stronie internetowej Platformy, tj. pod adresem https://miastokalisz.ezamawiajacy.pl

7. W postępowaniu, którego dotyczy niniejsze ogłoszenie będzie miała zastosowanie procedura, o której mowa w art. 24aa ustawy.

1. Odwołanie przysługuje wyłącznie od niezgodnej z przepisami ustawy czynności Zamawiającego podjętej w postępowaniu o udzielenie zamówienia lub zaniechania czynności, do której Zamawiający jest zobowiązany na podstawie ustawy.

2. Odwołanie powinno wskazywać czynność lub zaniechanie czynności Zamawiającego, której zarzuca się niezgodność z przepisami ustawy, zawierać zwięzłe przedstawienie zarzutów, określać żądanie oraz wskazywać okoliczności faktyczne i prawne uzasadniające wniesienie odwołania.

3. Odwołanie wnosi się do Prezesa Krajowej Izby Odwoławczej w formie pisemnej w postaci papierowej albo w postaci elektronicznej, opatrzone odpowiednio własnoręcznym podpisem albo kwalifikowanym podpisem elektronicznym.

4. Odwołujący przesyła kopię odwołania Zamawiającemu przed upływem terminu do wniesienia odwołania w taki sposób, aby mógł on zapoznać się z jego treścią przed upływem tego terminu. Domniemywa się, iż Zamawiający mógł zapoznać się z treścią odwołania przed upływem terminu do jego wniesienia, jeżeli przesłanie jego kopii nastąpiło przed upływem terminu do jego wniesienia przy użyciu środków komunikacji elektronicznej.

5. Zgodnie z art. 182 ustawy Prawo zamówień publicznych:

1) Odwołanie wnosi się w terminie 10 dni od dnia przesłania informacji o czynności Zamawiającego stanowiącej podstawę jego wniesienia – jeżeli zostały przesłane w sposób określony w art. 180 ust. 5 zdanie drugie ustawy Prawo zamówień publicznych albo w terminie 15 dni – jeżeli zostały przesłane w inny sposób.

2) Odwołanie wobec treści ogłoszenia o zamówieniu, a także wobec postanowień Specyfikacji Istotnych Warunków Zamówienia, wnosi się w terminie 10 dni od dnia publikacji ogłoszenia w Dzienniku Urzędowym Unii Europejskiej lub zamieszczenia Specyfikacji Istotnych Warunków Zamówienia na stronie internetowej.

3) Odwołanie wobec czynności innych niż określone w pkt 1) i 2) wnosi się w terminie 10 dni od dnia, w którym powzięto lub przy zachowaniu należytej staranności można było powziąć wiadomość o okolicznościach stanowiących podstawę jego wniesienia.

Group insurance for the lives of employees, spouses and adult children of employees of the City of Kalisz

1. The subject of the order is the implementation of group insurance for the life of employees, spouses and adult children of employees of the City of Kalisz with an estimated number of insured persons of 592.

2. The proceeding to which this announcement relates is conducted under an open tender procedure in accordance with art. 39 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2018, item 1986, as amended), referred to in this announcement as "the Act" or "PPL Act").

3. The proceeding to which this announcement applies is conducted only in electronic form using electronic means of communication via the Purchase Platform available at https://miastokalisz.ezamawiajacy.pl , referred to in this announcement as the "Platform".

City of Kalisz, POLAND.

1. The subject of the order is the implementation of group insurance for the life of employees, spouses and adult children of employees of the City of Kalisz with an estimated number of insured persons of 592.

2. A detailed description of the subject of the contract is included in the Annex to the Terms of Reference. "Detailed description of the subject of the order", including the scope of protection, including obligatory conditions, other additional provisions and optional clauses of group life insurance for employees, spouses and adult children of employees of the Kalisz City Council.

3. The proceedings are conducted with the participation of an insurance broker Nord Partner Sp. z oo with its registered office in Toruń, which acts as an insurance intermediary for and on behalf of the Employer. The insurance broker will mediate the conclusion of the contract concluded as a result of the award of the contract and then will supervise their implementation by the Contractor.

4. The estimated number of insured persons given in point 1 or SIWZ and annexes to the ToR is not an obligation of the Employer to join this number of people for insurance. The estimated number of insured was established for the purpose of determining the estimated value of the contract and ensuring the comparability of offers. The Contractor may not have claims for not joining the indicated number of people for group life insurance.

5. The remaining conditions of the contract are included in the draft contract constituting an annex to the ToR.

1. The Contractor is obliged to pay a deposit of PLN 5,000.00 before the deadline for submission of tenders.

2. Proof of payment of the bid security should be attached to the offer in accordance with the provisions of the ToR in this respect.

3. The period of being bound by the offer referred to in IV.2.6) of this announcement is 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

A. Contractors who can apply for the contract award are:

1. they are not subject to exclusion from the proceedings pursuant to art. 24 sec. 1 item 12-23 and art. 24 sec. 5 points 1, 8 of the Public Procurement Law;

2. meet the condition of participating in the proceedings regarding competences or entitlements to conduct a specific professional activity, i.e. they have the right to conduct insurance activity in accordance with the Act of 11.09.2015 on insurance and reinsurance activity - including group life insurance.

B. In the case of Contractors jointly applying for the award of a contract, none of them may be subject to exclusion from the proceedings for the reasons referred to in art. 24 sec. 1 item 12-23 and art. 24 sec. 5 points 1, 8 of the Act.

C. Each Contractor applying jointly for the award of a contract (submitting an offer jointly including: members of a consortium, partners in a civil partnership) must independently fulfill the condition referred to in point III.1) of this announcement.

D. The Contractor is obliged to submit together with the offer valid as of the day of submitting offers, a statement constituting preliminary confirmation that the Contractor is not subject to exclusion and fulfills the conditions for participation in the proceedings in the form of a single European order document (EED) prepared in accordance with the standard form set out in the Regulation implementing act of the European Commission issued on the basis of 59 par. 2 of Directive 2014/24 / EU. The Contractor is obliged to complete the EMS to the extent that the Employer can verify whether the Contractor is not subject to exclusion and meets the conditions for participation in the procedure set out in the ToR. In addition, in the case of Contractors jointly applying for the award of the contract, the form JEDZ is submitted by each of these Contractors.

E. In order to confirm the fulfillment of the condition of participation in the proceedings only at the request of the Awarding Entity, the Contractor is obliged to submit:

1) current authorization to conduct insurance activity issued in accordance with the provisions of the Act of 11.09.2015 on insurance and reinsurance activity (ie Journal of Laws of 2019, item 381, as amended) - art. 162 para. 1 above act or other corresponding authorization, which was issued on the basis of pre-existing legal provisions, or - in the case of commencement of activity before 28.8.1990 - a certificate issued by the Polish Financial Supervision Authority on having the right to conduct insurance activity or another document of the competent authority for performing insurance activities in the EU member state in which the establishment is established, confirming the possession of the right to conduct insurance activity in the scope of all groups of risks covered by the subject of the order.

If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the above-mentioned documents, he submits a document or documents issued in the country in which he is residing or confirming that he has the right to perform activities related to the subject of the contract.

A. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings only at the request of the Employer, the Contractor is obliged to submit the following declarations and documents:

1) information from the National Criminal Record in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act issued not earlier than 6 months before the deadline for submission of bids;

2) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables with possible interest or fines, in particular he obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

3) a certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtaining legally required exemption, postponement or spreading overdue payments or suspending the full implementation of the decision of the competent authority;

4) copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Act;

5) declaration of the Contractor about the lack of issuing to him a final court judgment or final administrative decision on delay in paying taxes, fees or social security or health insurance premiums, or - in the event of such a verdict or decision - documents confirming the payment of these claims together with any interest fines or the conclusion of a binding agreement regarding the repayment of these debts;

6) declaration of the Contractor about the lack of a ruling against him as a preventive measure of the prohibition to apply for public contracts;

7) declaration of the Contractor about non-payment of local taxes and charges, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2019, item 1170).

B. In the case of Contractors jointly applying for the contract, each of the Contractors is obliged to submit to the Ordering Party's request the documents mentioned in point III.1.2) A.1) -7) of this announcement concerning each of them.

C. In the case of Contractors operating in the form of a civil-law partnership, the aforementioned certificates in point III.1.2) A.2) -3) of this announcement must be presented in relation to all partners individually as well as the company itself.

D. Contractor, within 3 days of placing on the Ordering Party's website information referred to in art. 86 par. 5 of the Act, it provides the Ordering Party with a declaration of belonging or non-affiliation to the same capital group with Economic Operators who submitted separate offers in the procedure. In the event of a joint application for the contract by the Contractors, the aforementioned declaration is submitted by each of the Contractors jointly applying for the contract.

The Contractor having its registered office in the territory of the Republic of Poland, in relation to a person residing outside the territory of the Republic of Poland, to whom the document referred to in III.1.2) A.1) relates to this announcement, shall submit information from the relevant register or, in the absence of such the register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has his registered office or place of residence is the person to whom the information or document relates, to the extent specified in art. 24 sec. 1 point 14 and 21 of the Act - issued not earlier than 6 months before the deadline for submission of tenders. If the country in which the person concerned is to reside is not issued, then it is replaced by a document (issued not earlier than 6 months before the deadline for submission of tenders) containing a statement made by the person before the notary or before a judicial or administrative body or a body of professional or economic self-government competent for the place of residence of that person.

B. Documents of foreign entities

If the Contractor has its registered office or place of residence outside the territory of the Republic of Poland - instead of the documents referred to in point III.1.2) A.2) -4) of this announcement - submit a document or documents issued in the country in which the Contractor is established or place of residence confirming respectively that:

a) he is not in default of paying taxes, fees, social security or health insurance contributions or that he has entered into an agreement with the competent authority regarding the repayment of such receivables with possible interest or fines, in particular he obtained the legally required exemption, postponement or installment payment of payments or suspension in full of the implementation of the decision of the competent authority - issued not earlier than 3 months before the deadline for submission of tenders,

b) its liquidation has not been opened or bankruptcy announced - issued not earlier than 6 months before the deadline for submission of tenders.

C. If the Contractor is established or resides outside the territory of the Republic of Poland - instead of the documents referred to in point III.1.2) A.1) of this announcement - he shall submit information from the relevant register or, in the absence of such register, another equivalent document issued by the competent judicial or administrative body of the country in which the Contractor has its registered office or place of residence, the person to whom the information or document refers, to the extent specified in art. 24 sec. 1 points 13, 14 and 21 of the Act - issued not earlier than 6 months before the deadline for submission of tenders.

D. If in the country in which the Contractor has its registered office or place of residence or place of residence has the person to whom the document relates, no documents referred to in point III.1.3) are issued. B.-C. of this announcement, it is replaced by a document (issued not earlier than 3 or 6 months before the deadline for submission of tenders - see above) containing the Contractor's declaration, indicating the person or persons authorized to represent it, or a statement of the person to whom the document was to apply, submitted to a notary or before a judicial, administrative or professional self-regulatory or economic authority competent for the seat or place of residence of the Economic Operator or place of residence of that person.

The Awarding Entity does not specify the conditions for participation in the proceedings regarding technical capacity and professional qualifications.

1. An appeal shall lie only from the Employer's actions taken in the proceedings for the award of the contract or the failure to act, to which the Employer is obliged under the Act, which is inconsistent with the provisions of the Act.

2. The appeal should indicate the act or omission of the Employer's action, which is accused of non-compliance with the provisions of the Act, contain a brief statement of objections, specify the request and indicate the factual and legal circumstances justifying the appeal.

5. According to art. 182 Public Procurement Law:

1. The subject of the order is the implementation of group insurance for the life of employees, spouses and adult children of employees of the City of Kalisz with an estimated number of insured persons of 592.

2. The proceeding to which this announcement relates is conducted under an open tender procedure in accordance with art. 39 of the Act of 29.1.2004 Public Procurement Law (Journal of Laws of 2018, item 1986, as amended), referred to in this announcement as "the Act" or "PPL Act").

City of Kalisz, POLAND.

1. The subject of the order is the implementation of group insurance for the life of employees, spouses and adult children of employees of the City of Kalisz with an estimated number of insured persons of 592.

2. A detailed description of the subject of the contract is included in the Annex to the Terms of Reference. "Detailed description of the subject of the order", including the scope of protection, including obligatory conditions, other additional provisions and optional clauses of group life insurance for employees, spouses and adult children of employees of the Kalisz City Council.

3. The proceedings are conducted with the participation of an insurance broker Nord Partner Sp. z oo with its registered office in Toruń, which acts as an insurance intermediary for and on behalf of the Employer. The insurance broker will mediate the conclusion of the contract concluded as a result of the award of the contract and then will supervise their implementation by the Contractor.

4. The estimated number of insured persons given in point 1 or SIWZ and annexes to the ToR is not an obligation of the Employer to join this number of people for insurance. The estimated number of insured was established for the purpose of determining the estimated value of the contract and ensuring the comparability of offers. The Contractor may not have claims for not joining the indicated number of people for group life insurance.

5. The remaining conditions of the contract are included in the draft contract constituting an annex to the ToR.

1. The Contractor is obliged to pay a deposit of PLN 5,000.00 before the deadline for submission of tenders.

2. Proof of payment of the bid security should be attached to the offer in accordance with the provisions of the ToR in this respect.

3. The period of being bound by the offer referred to in IV.2.6) of this announcement is 60 days. The period of being bound by the offer starts as soon as the deadline for submission of tenders expires.

A. Contractors who can apply for the contract award are:

1. they are not subject to exclusion from the proceedings pursuant to art. 24 sec. 1 item 12-23 and art. 24 sec. 5 points 1, 8 of the Public Procurement Law;

2. meet the condition of participating in the proceedings regarding competences or entitlements to conduct a specific professional activity, i.e. they have the right to conduct insurance activity in accordance with the Act of 11.09.2015 on insurance and reinsurance activity - including group life insurance.

B. In the case of Contractors jointly applying for the award of a contract, none of them may be subject to exclusion from the proceedings for the reasons referred to in art. 24 sec. 1 item 12-23 and art. 24 sec. 5 points 1, 8 of the Act.

C. Each Contractor applying jointly for the award of a contract (submitting an offer jointly including: members of a consortium, partners in a civil partnership) must independently fulfill the condition referred to in point III.1) of this announcement.

D. The Contractor is obliged to submit together with the offer valid as of the day of submitting offers, a statement constituting preliminary confirmation that the Contractor is not subject to exclusion and fulfills the conditions for participation in the proceedings in the form of a single European order document (EED) prepared in accordance with the standard form set out in the Regulation implementing act of the European Commission issued on the basis of 59 par. 2 of Directive 2014/24 / EU. The Contractor is obliged to complete the EMS to the extent that the Employer can verify whether the Contractor is not subject to exclusion and meets the conditions for participation in the procedure set out in the ToR. In addition, in the case of Contractors jointly applying for the award of the contract, the form JEDZ is submitted by each of these Contractors.

E. In order to confirm the fulfillment of the condition of participation in the proceedings only at the request of the Awarding Entity, the Contractor is obliged to submit:

1) current authorization to conduct insurance activity issued in accordance with the provisions of the Act of 11.09.2015 on insurance and reinsurance activity (ie Journal of Laws of 2019, item 381, as amended) - art. 162 para. 1 above act or other corresponding authorization, which was issued on the basis of pre-existing legal provisions, or - in the case of commencement of activity before 28.8.1990 - a certificate issued by the Polish Financial Supervision Authority on having the right to conduct insurance activity or another document of the competent authority for performing insurance activities in the EU member state in which the establishment is established, confirming the possession of the right to conduct insurance activity in the scope of all groups of risks covered by the subject of the order.

If the Contractor is established or resides outside the territory of the Republic of Poland, instead of the above-mentioned documents, he submits a document or documents issued in the country in which he is residing or confirming that he has the right to perform activities related to the subject of the contract.

A. In order to confirm the absence of grounds for exclusion of the Contractor from participation in the proceedings only at the request of the Employer, the Contractor is obliged to submit the following declarations and documents:

1) information from the National Criminal Record in the scope specified in art. 24 sec. 1 points 13, 14 and 21 of the Act issued not earlier than 6 months before the deadline for submission of bids;

2) certificate of the competent head of the tax office confirming that the Contractor is not in arrears with paying taxes, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent tax authority regarding the repayment of these receivables with possible interest or fines, in particular he obtained the legally required exemption, deferral or payment in installments of overdue payments or suspension in full of the implementation of the decision of the competent authority;

3) a certificate of the relevant local organizational unit of the Social Insurance Institution or Agricultural Social Insurance Fund or other document confirming that the Contractor is not in arrears with paying social security or health insurance contributions, issued not earlier than 3 months before the deadline for submission of tenders, or other document confirming that the Contractor has entered into an agreement with the competent authority regarding the repayment of such receivables, together with any interest or fines, in particular obtaining legally required exemption, postponement or spreading overdue payments or suspending the full implementation of the decision of the competent authority;

4) copy from the relevant register or from the Central Register and Information on Economic Activity, if separate regulations require an entry in the register or records, in order to confirm the absence of grounds for exclusion under Article. 24 sec. 5 point 1 of the Act;

5) declaration of the Contractor about the lack of issuing to him a final court judgment or final administrative decision on delay in paying taxes, fees or social security or health insurance premiums, or - in the event of such a verdict or decision - documents confirming the payment of these claims together with any interest fines or the conclusion of a binding agreement regarding the repayment of these debts;

6) declaration of the Contractor about the lack of a ruling against him as a preventive measure of the prohibition to apply for public contracts;

7) declaration of the Contractor about non-payment of local taxes and charges, referred to in the Act of 12.1.1991 on local taxes and charges (Journal of Laws of 2019, item 1170).

B. In the case of Contractors jointly applying for the contract, each of the Contractors is obliged to submit to the Ordering Party's request the documents mentioned in point III.1.2) A.1) -7) of this announcement concerning each of them.

C. In the case of Contractors operating in the form of a civil-law partnership, the aforementioned certificates in point III.1.2) A.2) -3) of this announcement must be presented in relation to all partners individually as well as the company itself.

D. Contractor, within 3 days of placing on the Ordering Party's website information referred to in art. 86 par. 5 of the Act, it provides the Ordering Party with a declaration of belonging or non-affiliation to the same capital group with Economic Operators who submitted separate offers in the procedure. In the event of a joint application for the contract by the Contractors, the aforementioned declaration is submitted by each of the Contractors jointly applying for the contract.
