Les marchés sont des marchés de services traités à prix forfaitaires sur la base d'un taux de prime appliqué au coût définitif des travaux.les marchés prendront effet à compter de leur date de notification et s'achèveront à l'expiration des garanties indiquées au cahier des clauses particulières des marchés.

Par délibération du 10.4.2019, le cnseil municipal a attribué le marché de construction d'un complexe sportif — lot «Bâtiment — tout corps d'état» au groupement VINCI Construction France — SOGEA Nord-Ouest.

Les travaux ont ainsi démarré en juillet 2019 et s'achèveront en août 2021. Les marchés de travaux ayant été notifiés aux attributaires, il convient désormais de lancer un appel d'offres ouvert pour les services d'assurances construction afférents à cette opération.

Le téléchargement est gratuit. GPSO impose que les offres soient déposées par voie électronique en passant par https://marches.maximilien.fr en application de l'article R. 2132-7 du code de la commande publique.

Afin de simplifier les démarches des candidats, les offres déposées sur la plate-forme maximilien n'auront pas à être signées électroniquement. Par la seule remise de son offre, le candidat confirme son intention de soumissionner à l'attribution du marché. Ainsi, s'il est désigné attributaire, il s'engage à signer l'ensemble des pièces contractuelles du marché et à les remettre sous format papier à l'établissement public territorial. Pour chaque lot, le candidat peut apporter des réserves au cahier des charges. Elles doivent être numérotées et détaillées en annexe à l'acte d'engagement.

Critères d'analyse des offres:

1) Prix des prestations: 60 points de la note finale.

— sous-critère 1 — montant de la prime: 55 points de la note,

— sous-critère 2 — montant des franchises: 5 points de la note.

2) Étendue des garanties: 20 points de la note finale;

3) Gestion des dossiers: 20 points de la note finale.

Précisions concernant les délais d'introduction de recours:

— la procédure du référé précontractuel prévue à l'article L. 551-1 du code de justice administrative peut être mise en œuvre avant la signature du marché,

— la procédure du référé contractuel prévue aux articles L. 551-13 à L. 551-23 du code de justice administrative ne peut être mise en œuvre que si l'avis ex-ante volontaire prévu à l'article R. 2183-6 du code de la commande publique n'a été publié au JOUE et/ou que le pouvoir adjudicateur n'a pas observé les délais prévus à l'article L. 551-15 du code de justice administrative à compter de cette publication,

Les actes détachables du contrat ne peuvent être contestés qu'à l'occasion de ce recours.

Le budget de la ville financera les dépenses afférentes au marché.

La ville ne percevra pas de subventions pour le financement de la prestation, objet du marché. Le règlement, après constatation du service fait, est effectué par virement avec mandatement administratif dans le délai global de paiement en vigueur à compter de la présentation de la demande de paiement.

Le défaut de paiement dans ce délai fait courir de plein droit des intérêts moratoires au bénéfice du titulaire et du sous-traitant de 1^er rang, au taux d'intérêt de la principale facilité de refinancement appliquée par la Banque centrale européenne à son opération de refinancement principal la plus récente effectuée avant le 1^er jour calendaire du semestre de l'année civile au cours duquel les intérêts moratoires ont commencé à courir, majoré de 8 points. Les intérêts moratoires courent à partir du jour suivant l'expiration du délai global jusqu'à la date de mise en paiement du principal incluse.

Par ailleurs, le défaut de paiement dans ce délai entraîne également de plein droit, au bénéfice du titulaire, le paiement d'une indemnité forfaitaire de 40 EUR pour frais de recouvrement.
